Notwithstanding the above, either party may bring an individual claim in small claims court if the claim qualifies under the applicable small claims court rules, provided such action remains in small claims court and is not removed or appealed to a court of general jurisdiction.

Nothing in this Section shall prevent either party from seeking injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm, protect intellectual property, or enforce confidentiality obligations.
